Terms & conditions

These terms govern your use of the SwipeUp website and the SwipeUp Flex platform. By using either, you agree to what's set out below.

Who we are

SwipeUp LLC ("SwipeUp", "we", "us") provides embedded financing and payment technology to businesses in the United States. SwipeUp Flex is our financing product; SwipeUp PRO is our merchant payments product.

SwipeUp is a technology provider, not a lender or a bank. Credit decisions, loan agreements and funding are made by our lending partners under their own terms.

Using this website

You may use this website for lawful purposes only. You may not attempt to interfere with the site, access it through automated scraping, or reverse engineer any part of the platform.

Content on this site — including copy, design, logos and imagery — belongs to SwipeUp or its licensors and may not be reproduced without written permission.

Merchant accounts

To offer financing through SwipeUp Flex you must complete onboarding, including business verification and any underwriting requirements our lending partners set.

You are responsible for the accuracy of the information you submit, for keeping your account credentials secure, and for the actions of every user you grant access to.

We may suspend or close an account where we reasonably believe there is fraud, misuse, regulatory risk, or a breach of these terms.

Financing offers

Approval amounts, rates, terms and monthly payments shown anywhere on this site are illustrative examples. Actual offers depend on the applicant's credit profile and the lending partner's decision.

Financing is offered across a range of credit tiers. Not every applicant will be approved, and approved terms will vary.

Funds are disbursed to the merchant by the lending partner once the customer's agreement is signed and any required completion checks are met.

Fees and payouts

Merchant fees, discount rates and payout timing are set out in your commercial agreement with SwipeUp. Where those terms differ from this page, your agreement governs.

You agree not to charge a customer more for choosing financing than you would for any other payment method, unless permitted by law and your agreement.

Service availability

We work to keep the platform available and accurate, but we provide it "as is". We do not guarantee uninterrupted access, and we may change, pause or withdraw features.

Planned maintenance is communicated in advance wherever practical.

Liability

To the fullest extent permitted by law, SwipeUp is not liable for indirect or consequential losses, lost profits, or lost business arising from use of the platform.

Nothing in these terms limits liability that cannot lawfully be limited.

Changes and contact

We may update these terms as the product and applicable regulation change. The date at the top of this page shows the latest revision, and continued use of the platform means you accept the current version.
